Terms and conditions of purchase

1 - Terms of payment

1.1 Prices

The prices of the products offered for sale on the website are expressed in euros, inclusive of all taxes but excluding delivery charges.Shipping costs are displayed on the website at the time the Customer places the order.GC DEV reserves the right to modify its prices and shipping charges at any time. Products shall be invoiced on the basis of the rates in effect at the time the order is confirmed.If one or more taxes or contributions, particularly environmental taxes, are created or modified, either upwards or downwards, this change may be reflected in the selling price of the products on the website.In the event of an obvious error in the system or in the data, and in particular in the event of the display of an obviously derisory price resulting from an error, GC DEV reserves the right to cancel the order and refund the price paid by the Customer.Products remain the property of GC DEV until full payment has been received from the Customer.

2 - Deliveries

GC DEV makes deliveries via the carrier of its choice.GC DEV shall deliver the products ordered to the delivery address indicated by the Customer at the time the order was placed.Delivery times are indicated on the Internet Site when the order is placed and are indicative. GC DEV shall not be held responsible for the consequences of late delivery. In all cases, GC DEV undertakes, without undue delay, to deliver the products purchased no later than 30 days from the date the order is placed.In accordance with legal provisions, in the event of late delivery, the Customer may cancel the contract in accordance with the terms and conditions defined in Article L. 216-6 of the French Consumer Code. In this case, GC DEV will reimburse the product and, if applicable, the «outbound» costs in accordance with Article L. 216-7 of the French Consumer Code.The risk of loss or damage to products is transferred to the Customer when the latter, or a third party designated by the Customer, takes physical possession of the goods.GC DEV invites the Customer to verify the condition and contents of the package delivered before signing any delivery documents. In the event of an anomaly, GC DEV advises the Customer to make any necessary reservations or to refuse the package. The Customer must notify GC DEV on the day of delivery or no later than the first business day following delivery, any claim of error of delivery and / or non-conformity of goods in kind or quality compared to the indications on the order form. Any claim made after this deadline will be rejected.In all cases, GC DEV shall not be liable for any delay or non-delivery attributable to the carrier or otherwise caused by circumstances beyond its control.In the event that the Customer is absent, the carrier will notify the Customer of the location where the package may be picked up, as well as the time period allowed.

3 - Guarantees

3.1 Legal guarantees

GC DEV is bound by the legal warranty of conformity set forth in Articles L. 217-3 to L. 217-17 of the French Consumer Code.This guarantee only applies if the Customer requests it within two years of delivery of the goods. Conformity defects that appear within twenty-four (24) months of delivery are presumed to have existed at the time of delivery, unless proven otherwise.GC DEV shall also be bound by the legal warranty relating to hidden defects in the item sold, in accordance with the conditions set forth in Articles 1641 to 1648 of the French Civil Code.
Reminder of the conditions of the legal guarantee of conformity referred to in articles L. 217- 3 et seq. of the French Consumer Code: The legal guarantee of conformity entitles the consumer to repair or replace the goods within thirty days of his request, free of charge and without any major inconvenience to him.- If the goods are repaired under the legal conformity guarantee, the consumer benefits from a six-month extension of the initial guarantee.- If the consumer asks for the goods to be repaired, but the seller requires them to be replaced, the legal guarantee of conformity is renewed for a period of two years from the date on which the goods are replaced.- The consumer may obtain a reduction in the purchase price by keeping the goods or terminate the contract by obtaining a full refund in exchange for the return of the goods, if :1°) The trader refuses to repair or replace the goods; 2°) The goods are repaired or replaced after a period of thirty days; 3°) The repair or replacement of the goods causes a major inconvenience to the consumer, in particular where the consumer definitively bears the cost of taking back or removing the non-conforming goods, or if he bears the cost of installing the repaired or replacement goods; 4°) The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.- The consumer is also entitled to a reduction in the price of the goods or to rescission of the contract where the lack of conformity is so serious as to justify immediate reduction in the price or rescission of the contract. In such cases, the consumer is not obliged to ask for the goods to be repaired or replaced beforehand.- The consumer is not entitled to have the sale rescinded if the lack of conformity is minor.- Any period of immobilisation of the goods with a view to their repair or replacement suspends the warranty that was in force until delivery of the repaired goods.- The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the French Consumer Code.- Any seller who obstructs the implementation of the legal guarantee of conformity in bad faith is liable to a civil fine of up to 300,000 euros, which may be increased to 10 % of average annual sales (article L. 241- 5 of the French Consumer Code).Consumers also benefit from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept or to a full refund in return for the return of the goods - The consumer has a period of two years from the date of delivery of the goods in which to obtain the implementation of the legal guarantee of conformity in the event of the appearance of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date of its appearance.- Where the contract for the sale of the goods provides for the supply of digital content or a digital service on a continuous basis for a period of more than two years, the legal guarantee applies to this digital content or digital service throughout the period of supply. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or the digital service and not the date of its appearance.- The legal guarantee of conformity implies an obligation on the part of the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods.

 3.2 Warranty exclusions

These warranties do not cover damage resulting from the following: failure to comply with the installation instructions, instructions for use and maintenance advice for the Products; use of the Products for purposes other than those for which they are intended; deterioration and normal wear and tear of the Products; modification of the Products; or impact caused by torsion, compression, dropping or abnormal impact of the Product.

4 - Right of withdrawal

In accordance with articles L.221-18 et seq. of the French Consumer Code, in principle, the consumer Customer has the right to cancel his order without having to justify his decision or pay any penalties. Consumer Customers may exercise their right of withdrawal during the 14 days following the date on which the Customer, or a third party designated by the consumer and other than the carrier, takes physical possession of the last item ordered.It should be noted that the right of withdrawal does not apply to the supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.Consequently, for reasons of hygiene, the soles of shoes sold by LA SOCIÉTÉ GC DEV may not be the subject of a right of withdrawal, once their packaging has been unsealed.In the case of an order containing several products, the 14-day period runs from receipt of the last product. If the Customer wishes to exercise its right of withdrawal, it must inform GC DEV of its decision. The request must be made in writing (letter or e-mail) within 14 days of the date of receipt of the product. It must include the following information:

It is recalled that the goods travel at the risk of the Customer.In the event that the Customer exercises the right of withdrawal, GC DEV will reimburse all payments made by the Customer at the time of the initial purchase. However, the Customer shall bear the direct costs of returning the products to GC DEV. The refund will be made within a maximum of fourteen (14) days from the date that the Company GC DEV is informed of the Customer's decision to withdraw. The refund will be made using the same method of payment used by the Customer for the purchase, unless the Customer has expressly requested that the refund be made using other methods of payment, and unless the use of the same method of payment in which the initial purchase was made would result in additional costs for the Customer. In accordance with Article L. 221-24 of the French Consumer Code, GC DEV may defer reimbursement until the products have been recovered or until the Customer has provided proof of shipment of these goods.GC DEV is not obligated to reimburse additional delivery costs if the Customer has expressly chosen a more expensive method of delivery than the standard method offered by GC DEV.In the event of product depreciation resulting from unreasonable use of the product by the Customer and/or resulting from handling by the Customer other than that necessary to establish the nature and characteristics of the product, GC DEV reserves the right to reimburse the Customer an amount reduced by the loss of value of the product.
